Terms of service

These terms cover your use of Yellowbird, which is run by Alexander Dempster ("we" or "us") in England. By creating an account you agree to them.

Your account

  • You must be at least 16 to create an account.
  • You need a passkey to sign in, and backup codes to get back in if you lose it. Keep your codes safe: we can't recover an account without them.
  • You're responsible for what's sent from your account.
  • Usernames and aliases can't be transferred, and they aren't reused after an account is deleted.

Using Yellowbird fairly

Don't use Yellowbird to:

  • send spam, or bulk mail people didn't ask for
  • send phishing, malware or anything illegal
  • harass, threaten or impersonate anyone
  • get around the limits of your plan, or disrupt the service for others

We may limit or close accounts that do. If we suspend your account, we'll email you the reason. While it's suspended you can still sign in, read and download your mail, delete your account, and write to support@yellowbird.email, but you can't send other mail, receive new mail, or change your aliases and settings.

Plans and limits

Each plan has limits on storage, aliases and sending. They're listed in Free and paid plans. On a free plan, your oldest mail is deleted when your storage is full.

We may raise the limits of your account, for example when you ask us to, and we may lower them if you break the fair use rules above. Settings always shows the limits that apply to you.

Paying

  • The paid plan costs €3.49 a month or €34.99 a year, including tax. Payments are handled by Creem, which sells you the plan as the merchant of record, so their terms also cover your purchase.
  • Your plan starts as soon as you've paid, and renews automatically until you cancel.
  • When you cancel, your plan runs to the end of the period you've paid for, then your account moves to the free plan.
  • If a payment fails, your account moves to the free plan straight away. Nothing is deleted for 3 days. After that, if your mail is over the free plan's storage, the oldest is deleted to make room. Your paid plan comes back if the payment goes through later.
  • Deleting your account ends your plan without a refund, so ask for any refund you're due first.

Refunds and your right to withdraw

You can get a full refund within 14 days of your first payment, or of a yearly renewal. Monthly renewals aren't refunded. A refunded plan ends straight away.

If you're a consumer in the UK or the European Union, you also have the legal right to withdraw from your purchase within 14 days, without giving a reason. Your plan starts at your request as soon as you've paid, and if you withdraw within those 14 days you get a full refund, as above.

To ask for a refund or to withdraw, email support@yellowbird.email with your username. To withdraw, any clear statement that you want to is enough.

Your mail

Your mail is yours. We store and process it only to run the service, as described in our Privacy notice.

Availability

We work to keep Yellowbird running and your mail safe, but we can't promise the service will never be interrupted or that mail will never be lost. Export anything you can't afford to lose.

Our liability

Nothing in these terms limits our liability where the law doesn't allow it to be limited, such as for death or personal injury caused by negligence, for fraud, or for harm we cause intentionally or through gross negligence. It also doesn't affect your rights as a consumer.

Otherwise, as far as the law allows:

  • we aren't liable for losses we couldn't reasonably have foreseen, or for lost profits, business or data
  • our total liability to you is limited to what you paid us in the 12 months before the claim

Closing your account

You can delete your account at any time in Settings. We'll give you notice before closing an account, unless it's breaking these terms.

Changes

We'll update the date at the top when these terms change, and tell you about important changes before they apply.

Law and disputes

These terms are governed by the law of England and Wales, and its courts can hear any dispute about them. If you're a consumer, you keep the protections of the law where you live, and you can also bring a claim in your local courts.
